Scope
These Terms and Conditions apply to the use of the MINTCASED website and to contracts concluded through our online store.
By placing an order, the customer accepts these Terms and Conditions together with the applicable Privacy Policy, Shipping Policy, Right of Withdrawal Policy and Returns Policy.
Any conflicting or additional terms submitted by the customer shall not apply unless we have expressly accepted them in writing.
Mandatory consumer rights under national and European law remain unaffected.
1. Eligibility to Place an Order
To place an order independently, you must be at least 18 years old or otherwise have the legal capacity required under applicable law.
Minors may use the store only with the consent and under the responsibility of their legal representative.
You may not use the website, products or services for unlawful purposes or in violation of applicable laws.
2. Formation of the Contract
The presentation of products in the online store does not constitute a legally binding offer. It is an invitation for customers to submit an order.
By adding products to the shopping cart and completing the checkout process, the customer submits a binding offer to purchase the selected products.
After the order has been submitted, the customer will receive an automatic acknowledgement of receipt. This acknowledgement confirms that the order has been received but does not necessarily constitute acceptance of the offer.
The contract is concluded when we:
- send an express order confirmation;
- confirm that the order has been dispatched; or
- begin fulfilling the order.
The contract text and order information may be stored in accordance with the information provided during the checkout process.
3. Products and Availability
The main characteristics of each product are described on the relevant product page.
Product availability may be limited. If an ordered item is unavailable, we will inform the customer without undue delay and refund any payments already received.
We may reasonably limit the quantity of products that can be purchased by a customer or included in a single order, particularly to prevent fraud, technical errors or unauthorised commercial resale.
Product images are provided for illustrative purposes. Minor differences in colour may result from screen settings, lighting conditions or the device used to view the website.
These differences do not affect the customer’s legal rights where the product does not conform to its contractual description.
4. Prices and Payment
The prices applicable to an order are those displayed at the time the order is placed.
Unless otherwise stated, prices include any applicable VAT. Shipping costs and any additional charges will be displayed before the customer completes the order.
We may change product prices for future orders. Price changes do not affect contracts that have already been concluded.
Available payment methods are displayed during checkout and may be provided by third-party payment service providers.
The customer must provide complete and accurate payment, billing and delivery information.
5. Refusal or Cancellation of Orders
We may refuse an order before a contract has been concluded or cancel an order where permitted by law, particularly when:
- the product is unavailable;
- the information provided is incomplete or clearly incorrect;
- payment is not authorised;
- there are reasonable indications of fraud or misuse;
- there is an obvious error in the price or product description.
If a paid order is validly cancelled, we will refund the amounts received without undue delay.
6. Delivery
Available delivery regions, carriers, shipping costs and estimated delivery times are described in our Shipping Policy.
Delivery times are estimates unless a binding delivery date has been expressly agreed.
The consumer’s legal rights in the event of delay, non-delivery, damage or loss remain unaffected.
7. Right of Withdrawal, Returns and Exchanges
Consumers may have a statutory right to withdraw from a distance contract within 14 days, subject to the exceptions provided by law.

Nothing in this section limits the customer’s legal rights regarding defective or non-conforming products.
8. Legal Warranty
All products are covered by the statutory conformity and warranty rights provided under German and European consumer law.
The customer retains all legal remedies where a product is defective, does not match its description or is not suitable for its intended purpose.
Any additional commercial guarantee offered by MINTCASED does not restrict or replace the statutory warranty.
For new consumer goods, statutory defect claims are generally subject to a limitation period of two years from delivery, subject to the applicable law.
9. Customer Accounts
Where customer accounts are available, customers are responsible for keeping their login details confidential and for activities carried out through their accounts.
Customers must inform us without undue delay if they suspect unauthorised access to their account.
We may suspend an account where there are reasonable grounds relating to security, fraud, misuse or a material breach of these Terms.
10. Third-Party Tools and Services
The website may include services or tools provided by third parties, including Shopify, payment providers, shipping carriers and external applications.
The use of these services may be subject to the terms and privacy policies of the relevant provider.
We are not responsible for third-party services to the extent that the issue concerned is not caused by a breach of our own legal or contractual obligations.
11. External Links
The website may contain links to pages operated by third parties.
These links are provided for convenience. Unless expressly stated otherwise, they do not mean that we endorse, control or accept responsibility for the external content.
Customers should review the applicable terms and privacy policies before using third-party websites or services.
12. Reviews, Comments and User Content
When a customer voluntarily submits a review, comment, photograph or other content, the customer confirms that they possess the rights required to submit and publish that content.
Submitted content must not:
- infringe copyright, trademark rights, privacy rights or other third-party rights;
- contain false, unlawful, offensive or discriminatory material;
- include malware, spam or misleading content.
To the extent necessary for publishing, promoting and operating the store, the customer grants us a non-exclusive, royalty-free licence to use, reproduce and display the submitted content and to allow our technical service providers to do the same.
This licence does not transfer ownership of the content and may be revoked for future use, unless continued storage is required to meet legal obligations or protect legitimate rights.
We may moderate or remove unlawful content or content that violates these Terms.
13. Intellectual Property
The website, texts, logos, designs, photographs, graphics and other content belonging to MINTCASED or its licensors are protected by intellectual property law.
They may not be copied, modified, distributed, resold or used commercially without permission, except where such use is permitted by law.
Purchasing a product does not transfer any rights in the MINTCASED trademarks, designs or website content.
14. Prohibited Uses
You may not:
- use the website for unlawful or fraudulent activities;
- infringe intellectual property rights or personal rights;
- transmit viruses, malware or harmful code;
- carry out unauthorised automated scraping;
- interfere with the security or operation of the website;
- collect personal data belonging to other users without a lawful basis;
- send spam or misleading communications;
- bypass technical restrictions or security measures.
In the event of a material violation, we may restrict or terminate access to the service, without prejudice to any further rights available under the law.
15. Correction of Errors
We may correct typographical errors, technical inaccuracies or incomplete information on the website.
Where an error affects an order that has already been submitted, we will inform the customer and apply the remedies required by law.
We will not unilaterally amend an already concluded contract to the consumer’s disadvantage.
16. Liability
We are liable without limitation:
- for intent and gross negligence;
- for injury to life, body or health;
- under mandatory product liability law;
- where we have expressly provided a guarantee;
- in any other case where liability cannot legally be excluded or limited.
Where we negligently breach an essential contractual obligation, our liability is limited to the typical and reasonably foreseeable damage at the time the contract was concluded.
An essential contractual obligation is one whose performance is necessary for the proper fulfilment of the contract and on whose fulfilment the customer may normally rely.
In all other cases, liability for ordinary negligence is excluded to the extent permitted by law.
These limitations also apply to our legal representatives, employees and agents.
17. Customer Responsibility
The customer is responsible, under the general rules of applicable law, for damage caused by their own culpable violation of the law, these Terms or the rights of third parties.
The customer is not required to indemnify us for responsibilities that legally remain with MINTCASED.
18. Data Protection
Personal data is processed in accordance with our Privacy Policy and applicable data protection law.
Payment information may be processed directly by payment service providers in accordance with their own privacy policies.
19. Severability
If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions shall remain effective.
The invalid provision shall be replaced by the applicable statutory rule.
This clause does not limit European consumer protection rules under which unfair contractual terms are not binding on consumers.
20. Duration and Termination of Use
Customers may stop using the website at any time.
We may suspend access to the services in cases involving serious violations, fraud, security risks or other legitimate reasons.
Termination of access to the website does not remove obligations arising from orders or contracts already concluded.
21. Changes to These Terms
We may amend these Terms for future use where reasonably necessary, including because of legal, technical or organisational changes.
The version applicable to an order is the version available when the relevant contract is concluded.
Changes published later do not retroactively modify contracts that have already been concluded.
22. Governing Law and Jurisdiction
The law of the Federal Republic of Germany applies.
For consumers residing in another country, this choice of law does not deprive them of the protection granted by mandatory provisions of the law of their country of residence.
Jurisdiction is determined by the applicable statutory rules.
Exclusive jurisdiction at the registered place of business of MINTCASED applies only where such an agreement is legally permitted, particularly in contracts with merchants or other business customers.
23. Entire Agreement
These Terms, together with the policies referred to in them and the information displayed during checkout, govern the contractual relationship between MINTCASED and the customer.
Any individual agreement expressly concluded with the customer takes priority over these standard Terms.
